HUD homes are sold "as is" - no warranties stated or implied. Earnest money is required with all offers, along with a letter from a lender showing proof of funds or commitment to provide financing.
Multi offer situations are becoming more popular once again - not only for short sales and foreclosures.
We are seeing new properties - first time on the market homes, farms and ranches - also receiving multiple offers.
No matter if you are in Florida or in Missouri, the rules are the same: An agreement is not binding until ALL parties have signed the required documents.
I had a buyer’s agent call me today and tell me he was upset because we have multiple offers on my short sale listing in Davenport, FL. He called on a Friday and asked if we had any offers (at the time we didn’t) and I told him no. However, the price was just reduced that morning and we would likely have offers come in over the weekend because the new listed price was very competitive. That evening I received his buyer’s offer and called him to let him know I had it and would be forwarding it to the seller.
Over the weekend we did indeed get multiple offers, as I suspected we would. So on Monday morning, in the interest of fairness, I sent out an email to each buyer’s agent letting them know we had multiple offers and needed their buyer’s highest and best offer. This particular agent called me and was quite upset that I had presented other offers to the seller. His words exactly were “In our offer, we checked the box in the short sale addendum that the seller can’t accept any other offers.” To which I responded “What are you talking about?”
The Florida FAR/BAR short sale addendum does have this clause in it. Here is the clause in question.
A buyer and seller of a Short Sale can either decide to let the seller accept back-up offers or not. Anything is negotiable. If we had an executed contract and option A was checked then yes, he would have cause for concern. However, the last time I checked, an offer only signed by the buyer is not an executed contract. It’s just an offer. No matter how many classes you take about distressed properties or distressed property designations you have (this guy had them all) if you don’t know the law (as in your state’s contract law) you can’t succeed in this business.
Everything in real estate, and business for that matter, has to be in writing. An agreement or contract between the buyer and seller is not binding until BOTH PARTIES HAVE SIGNED IT. It’s a tough market right now and I understand there is some emotion involved, but we have to step up as professionals and there is a minimum mount of knowledge every agent should possess. Let’s step it up for our customers.Search For Homes In Central Florida

Family Share Day in Phillipsburg MO - Saturday September 18th
The Empowering Women Mission Project will have their next Family Share Day on Saturday September 18th, 2010. Doors open at 8:30 am. This event will be held in the fellowship hall of the Phillipsburg United Methodist Church in Phillipsburg MO.
Family Share Day is similar to a very large garage sale - except - all items are FREE. Clothing, household items, toys, books, etc will be available to the community. Everyone is invited to come and "shop" for their family. Membership in the Phillipsbug United Methodist Church is NOT required; no proof of need required.
Sandy Sipes is the coordinator of the Empowering Women Project in central Missouri. In addition to the Family Share Day, Sandy meets weekly with other women dedicated to assisting their communities. They assist women and connect women with resources in the community, such as The Cope House, the Free Store, the Phillipsburg Food Pantry and the Conway Food Pantry.
Any items used in a household setting, especially kitchen utensils, sheets/blankets, clothing and baby items are greatly appreciated. In years past, the Family Share Day has provided shoes, coats, bedding, books, TV's, radios, towels, book bags and so much more! Please bring items that are clean and that you would take home if needed - there is no way to dispose of broken items at the church.
Donations of items may be brought to the church from 4 pm until 5:30 pm on Tuesday September 14th. You may call Sandy to arrange a different drop off time if September 14th does not work for you. Or if you are in Lebanon and Laclede County; Marshfield and Webster County; or Buffalo and Dallas County, call Sandy at 417-589-3113 begin_of_the_skype_highlighting 417-589-3113 end_of_the_skype_highlighting to arrange a time for someone to pick up your items.
** Please do not leave items outside the church.

I had recently considered writing a post about tornados, tornado warnings and basements. I never went past the consideration stage so I was pleased to read the post below.
Growing up in Illinois, I remember numerous tornados. One in particular took out a large stretch about a mile from our home. The sound was incredible. No one was injured, no one was killed.
Tornados are a fact of life, a reality. And no, I am not mentally ill!
~~~~~~~~~~~~~~~~~~~~~~~~~
I work with a lot of buyers from out of state. A large percentage of them ask for a home with a walkout basement. It is obvious that many of these buyers do not need the basement for the space. They are wanting shelter from tornados.
I recently worked with some buyers who had a basement home as their #1 criteria. Several months into the process, it was obvious that the only homes we were going to find that fit all of their other criteria were not going to have basements. We finally found one home that both husband and wife loved. The only problem...it didn't have a basement.
The husband finally asked me: "Aren't you worried about tornadoes?"
My response: "Not really. I suppose I'm used to them."
I'm a native in the Springfield/Ozark area. I have grown up around tornados and tornado warnings. (Knock on wood) I've not been blown away yet. Tornados are a part of life to natives of our area. I am actually more afraid of hurricanes and earthquakes, probably because I've never experienced one. I think our fears are rooted in what we are unfamiliar with.
As we sat down to write an offer, imagine my surprise when I pulled the Seller's Disclosures to find in big print at the top, "EXTENSIVE REMODELING IN 2006 DUE TO TORNADO DAMAGE." Hmmm. Great. My clients fears are justified. The husband asked HOW MUCH damage was done. A call to the listing agent confirmed that $120,000 worth of damage was done to the home. Since this home didn't have a basement, my clients wanted to know if the sellers were home when the tornado hit, and where they were in the house. The listing agent encouraged us to call the seller directly. Here's how the conversation went.
Me: Were you home at the time of the tornado?
Seller: Yes.
Me: Where were you in the house?
Seller: Well, my wife was in the hall bathroom, and I was on the front porch. The tornado hit about 1:00 a.m., and it was pitch black outside. We heard on the radio reports that the tornado was headed straight towards our home. I stood on our front porch for about 10 minutes. Finally, a bolt of lightening lit up the sky, and I could see it right across the street. My wife yelled, "Hurry up, it's coming." I turned and started for the hall bathroom and yelled, "No, it's here!" and barely got the door shut before the dining room windows broke.
Neither of the sellers were injured. Fortunately, their homeowners insurance paid for the damage, and the wife was thrilled that she was actually able to make numerous other upgrades throughout the home with the money they received from insurance.
After we hung up the phone, my client looked at me very seriously and said, "I can't buy that home. I don't believe the seller is in his right mind, and believe he is incapable of making any decisions regarding any contracts." My client honestly believed the sellers were mentally ill.
Maybe we are crazy. As I am writing this, there is a tornado warning in my area. The tornado sirens are on, and the electricity is flickering on and off. Me....I'm in my garage in a lawn chair with my laptop. As I peek out the garage door, I can see people standing in front of nearly every home down my street. What are they doing? Watching for the tornado....of course.
If you are thinking of moving to Springfield, Missouri, and have a fear of tornados, consider buying a walkout basement home. However, if a basement is not in your budget, visit Missouri Storm Shelters. For $3,500 you can have an inground concrete shelter installed....a price that costs much less than a basement home.
